Qaḍāʾ ʿalā al-ghāʾib is a specific term to take a decision in the absence of a party. Although it is looking beyond the justice apparently, but it is necessary to adopt the phenomena for the safety of the other party. To linger on the decision has a fatal effect and can deny objectivity. To understand true spirit of Shariah, it is mandatory to understand “Objective of Shariah”. The decision which is cause of miscarriage of law, justice and objective of Shariah cannot be accepted. This article is all about ex-party decision and objective of Sharia and opinions of different juristics regarding the matter.
